1. Introduction
Welcome to Kind Mom Loving Dad that operates under the company OK IT Consulting ApS, Bakkegade 1A, 3600 Frederikssund, Denmark (CVR: 46067754) ("we," "our," or "us"). By accessing or using our voice cloning and audio generation platform, you agree to be bound by these Terms of Use ("Terms"). Please read them carefully.
2. Important Disclaimer
ENTERTAINMENT SERVICE ONLY
Kind Mom Loving Dad is an entertainment service. This platform is NOT intended for any medical, therapeutic, or mental health purposes. Any emotional or psychological comfort derived from using our service is incidental and not a claimed therapeutic benefit.
Consent for uploading the voice is not verified by us. By using our platform we rely on the user's assurance of necessary rights and permissions.
3. Age Requirements
You must be at least 18 years old to use this service. By using our platform, you represent and warrant that you meet this age requirement.
4. Consent Requirements
4.1 Voice Owner Consent. You must obtain explicit consent from the person whose voice you intend to clone before uploading any voice samples. You are solely responsible for ensuring you have the legal right to create and use cloned voices.
4.2 Voice Cloning Agreement. By uploading a voice sample, you represent and warrant that:
- You are the voice owner OR have obtained explicit consent from the voice owner
- The voice sample will be used only for personal, entertainment purposes
- The voice will not be used to deceive, defraud, or harm others
- You will not use cloned voices for illegal, harmful, or malicious purposes
5. Acceptable Use Policy
You agree NOT to use our service to:
- Create deepfakes, impersonations, or misleading content
- Impersonate any person or entity without permission
- Generate content that is illegal, harmful, threatening, abusive, or defamatory
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Create content for commercial purposes without appropriate authorization
We reserve the right to report fraud, impersonation, or unlawful acts to authorities and to close the account without returning funds.
6. Data Retention and Deletion
6.1 Voice Samples. Voice samples are automatically deleted after 24 hours for free users, or 90 days after your prepaid hours expire for paid users.
6.2 Generated Audio. Generated audio files are automatically deleted after 30 days for free users, or 90 days after your prepaid hours expire for paid users.
6.3 Account Deletion. You may request deletion of your account and all associated data at any time through your account settings.
7. AI System Training
7.1 Pre-Trained System. The text-to-speech (TTS) system used by our platform is pre-trained on public domain audio samples. Your voice samples are NOT used to retrain or improve the underlying AI model.
7.2 Voice Embeddings. When you upload a voice sample, we create a personal voice embedding specific to your account. This embedding is used only to generate audio in that voice for you and, if applicable, your family members.
7.3 No Model Training. We do not use your voice samples, generated audio, or scripts to train any AI models. Your data is used solely to provide the service to you.
8. Family Sharing
8.1 Family Groups. When you purchase 10 or more prepaid hours, you may create a family group and invite up to five family members by email. Family members can access shared voice clones, scripts, and generate audio using the family's pooled hours.
8.2 Owner Responsibilities. As the family group owner, you are responsible for ensuring that all voice samples uploaded to the family group have proper consent from the voice owners. You may revoke family member access at any time.
8.3 Member Conduct. Family members must comply with these Terms and may only use shared voices and scripts for personal, entertainment purposes within their family.
9. Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
10. Intellectual Property
10.1 Platform Content. The platform, including all software, text, graphics, and logos, is owned by us and protected by intellectual property laws.
10.2 User Content. You retain ownership of voice samples you provide. However, you grant us a limited license to process, store, and use your voice samples solely to provide the service.
11. Disclaimers
11.1 No Warranties. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
11.2 Not Professional Advice. This service is not a substitute for professional medical, therapeutic, or mental health advice.
12. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, damages, costs, or expenses arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
We reserve the right to suspend or terminate your account immediately with no notice if you violate these Terms or engage in any activity that we believe is harmful to the platform or others.
15. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
16. Changes to These Terms
We may update these Terms from time to time. We will notify users of significant changes via email. Your continued use of the service after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles.
